Terms of Use

These Terms govern your use of Pinche Chess®, Pinche Live®, Pinche Library®, and related services provided by The AgroStore LLC, a Delaware company.

1. Acceptance and eligibility

By using the service, you agree to these Terms and our Privacy Policy. You must be at least 13 years old and legally capable of accepting these Terms. If local law requires parental permission, you may use the service only with that permission.

2. Chess service

Pinche Chess provides real-time chess, ratings, player profiles, game history, live streaming, comments, published games, and related community features. Features may change, be interrupted, or be discontinued as the service evolves.

3. Player identity

You must not impersonate another person, misrepresent your identity, interfere with games, exploit technical errors, manipulate ratings, automate abusive activity, or attempt unauthorized access to the service.

4. Community conduct

You may not publish, stream, or transmit unlawful, threatening, harassing, hateful, sexually exploitative, fraudulent, defamatory, privacy-invasive, or infringing content. You may not expose private information, encourage violence, distribute malware, spam users, or abuse reporting and purchase systems.

5. User-generated content

You retain ownership of content you create. You grant The AgroStore LLC a worldwide, non-exclusive, royalty-free license to host, transmit, reproduce, format, display, moderate, and distribute that content as reasonably necessary to operate and promote Pinche Chess and its published game experiences.

We may review reports and remove content, restrict features, suspend players, or terminate access when reasonably necessary for safety, security, legal compliance, or enforcement of these Terms.

6. Pinche Live

You are responsible for everything your camera and microphone transmit. You must have permission to broadcast people, music, artwork, locations, conversations, and other protected material. Pinche Live is public or audience-facing and must not be treated as a private communication channel.

7. Stars and in-app purchases

Stars are consumable virtual items purchased through supported app-store billing systems. Stars may be used within eligible Pinche Chess features. Stars have no cash value, are not cryptocurrency, are not a bank account, cannot be used for gambling, and are not transferable outside supported service functionality.

iOS purchases are processed by Apple. Pricing, taxes, billing, refunds, and payment disputes are governed by Apple’s applicable terms and policies. A completed purchase may be reversed or adjusted where required for refunds, fraud, chargebacks, duplicated transactions, legal obligations, or store corrections.

8. Intellectual property

Pinche Chess®, Pinche Live®, Pinche Library®, PincheTulum®, The AgroStore LLC®, associated branding, software, designs, and original service content are protected by applicable intellectual-property laws. These Terms do not transfer ownership of our technology or brands.

9. Reports, blocks, and enforcement

Users can report inappropriate activity and block abusive players where supported. Reports may be reviewed, preserved, and shared with authorities when reasonably required. Submit urgent safety or moderation concerns to alejandrobarakat@gmail.com.

10. Availability and game records

Internet services can fail or become delayed. We do not guarantee uninterrupted games, streams, matchmaking, exact audience size, permanent publication, or error-free ratings. We may correct corrupted records, duplicated credits, or technical errors.

11. Disclaimer

To the maximum extent permitted by law, the service is provided “as is” and “as available,” without warranties of uninterrupted availability, fitness for a particular purpose, or non-infringement. Nothing in these Terms limits rights that cannot legally be waived.

12. Limitation of liability

To the maximum extent permitted by applicable law, The AgroStore LLC will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of the service. Any limitation applies only to the extent permitted in your jurisdiction.

13. Termination

You may stop using the service at any time. We may restrict or terminate access for violations, fraud, security threats, legal requirements, or material risk to users or the service.

14. Apple terms

For downloads through Apple’s App Store, Apple’s applicable App Store terms and the Apple Standard End User License Agreement also apply. Apple is not responsible for operating Pinche Chess or providing its support.

15. Governing law

These Terms are governed by the laws applicable to The AgroStore LLC in Delaware, United States, without overriding mandatory consumer protections that apply where you live.
